District court. The case of Frank G. White et al, vs. George Atchinson et al, was called for trial yesterday morning. This case grew out of the sale of the Boulder ditch to plaintiff in an early day, on which sale a payment of $10,000 was made, and the balance when a perfect title could be given. This suit is for the recovery of the amount paid. Plaintiff's attorney asked leave to reply to the amended petition of defendent, which brought out a lengthy discussion. The case was continued to this morning. Albert S. Miner vs. Samuel Kirk. Defendent's counsel consented to an order, confirming the judgment of the lower court. S. Bemis vs. A. Giles. Appellant not appealing, on motion of Albert Allen for the respondent, the appeal was dismissed for want of prosecution.
